AI Communication Features – Supplemental Terms 

Addendum to Customer Terms of Use

Effective May 15, 2026

These Supplemental Terms (“Supplemental Terms”) are Additional Terms as described in the customer terms of use governing the applicable platform (as revised from time to time, the “Base Terms”) and govern Customer’s access to and use of the AI Communication Features (as defined below). The entity providing the Services under the Base Terms is referred to in these Supplemental Terms as “Provider,” which for purposes of these Supplemental Terms means the entity identified as the service provider under the Base Terms. By opting in to an AI Plan, Customer agrees to be bound by these Supplemental Terms. In the event of any conflict between these Supplemental Terms and the Base Terms, these Supplemental Terms control solely with respect to the AI Communication Features; the Base Terms otherwise remain in full force and effect. 

BY CLICKING “I AGREE,” CHECKING AN ACCEPTANCE BOX, OR OTHERWISE ACCESSING OR USING THE AI SERVICE, CUSTOMER AGREES TO BE BOUND BY THESE ADD-ON TERMS.

1. Definitions

“AI Communication Features” means the AI-assisted communication and workflow automation add-on services made available by Provider as part of an AI Plan, which use automation and AI to manage prospective tenant outreach, including the generation of outbound calls and text messages to Leads, multi-channel communication ingestion, and workflow routing and categorization in connection with property management operations.

“AI Plan” means the subscription add-on under which Customer has elected to receive AI Communication Features, as set out in Customer’s applicable Plan.

“Customer Data” has the meaning given to it in the Base Terms, and for purposes of these Supplemental Terms includes Lead Personal Data processed through the AI Communication Features, including Lead contact information, inquiry data, call transcripts, summaries, and call outcome data.

“Lead” means a prospective tenant who: (a) submits an inquiry about a Customer property listing via a listing platform for the purpose of scheduling a tour but does not actually schedule such tour; and/or (b) schedules or completes a tour of a Customer property but does not thereafter submit a rental application or execute a lease agreement for such property. For billing purposes, the same prospective tenant may constitute more than one Lead if such prospective tenant satisfies clause (a) and/or (b) for more than one property (using the same or different contact information).

“Personal Data” means any information relating to an identified or identifiable natural person, as defined under applicable Data Protection Laws, and includes Lead contact information, call transcripts, summaries, scheduling data, and other data processed through the AI Communication Features that relates to an individual.

“Sub-processor” means a third-party subcontractor engaged by Provider that processes Personal Data as part of Provider’s delivery of the AI Communication Features.

2. AI Features; Activation

2.1 Opt-In. The AI Communication Features are not active by default. Provider will activate the AI Communication Features for Customer’s account only after Customer has expressly opted in by clicking the designated acceptance mechanism or executing an Order Form incorporating these Supplemental Terms.

2.2 What Provider Does. Once activated, and subject to the AI Plan, Provider will, on Customer’s behalf: 

(a) generate outbound calls and texts to Leads, using a phone number provisioned through Provider’s telephony infrastructure, to follow up on tour inquiries and scheduled showings; and

(b) in each case, limit outreach to a maximum of three (3) texts and three (3) calls per Lead per property, and cease outreach upon the Lead scheduling a tour, submitting a rental application, executing a lease, or opting out of communications, whichever occurs first.

2.3 Consent and Disclosures. Provider is responsible for obtaining any legally required consents from Leads before initiating AI-assisted calls or texts, and for providing any required disclosures to Leads, in connection with the AI Communication Features. Notwithstanding the foregoing, Provider’s consent obligation under this Section 2.3 is conditioned on Customer providing accurate and complete Lead contact data and maintaining accurate suppression lists; any failure to obtain consent arising from inaccurate, incomplete, or outdated data or suppression information provided by Customer is Customer’s responsibility and not Provider’s.

2.4 Customer’s Role. Customer’s obligations in connection with the AI Communication Features are to:

(a) provide accurate and up-to-date property listing data, rental requirements, qualification criteria, and Lead contact information that will inform AI-generated communications;

(b) promptly update such information to reflect changes in property availability, pricing, or leasing terms, and maintain accurate opt-out and suppression lists;

(c) ensure that its leasing policies, qualification criteria, and screening practices comply with the Fair Housing Act (42 U.S.C. § 3601 et seq.) and all applicable anti-discrimination laws — Provider has no visibility into and no responsibility for Customer’s leasing decisions; and

(d) not use the AI Communication Features for any purpose prohibited under the Base Terms or otherwise prohibited by applicable law.

3. Data & Privacy

3.1 Processing by Sub-processors. Customer acknowledges that the AI Communication Features rely on Sub-processors, including artificial intelligence model and infrastructure providers, to generate communications and process Personal Data. These Sub-processors process Personal Data (including Lead contact information, call transcripts, and property data) as part of delivering the AI Communication Features. The Sub-processors engaged by Provider in connection with the AI Communication Features as of the Effective Date are set forth in Schedule 1 to these Supplemental Terms. The Sub-processors listed in Schedule 1 are in addition to, and do not replace, any sub-processors disclosed under Provider’s data processing terms or Privacy Policy governing the Services. Provider shall notify Customer of any intended addition or replacement of Sub-processors engaged in connection with the AI Communication Features by updating Schedule 1 and providing Customer with written notice as soon as reasonably practicable. If Customer objects to a new or replacement Sub-processor on reasonable data protection grounds, Customer shall notify Provider in writing within seven (7) days of receipt of Provider’s notice, and the parties shall discuss Customer’s concerns in good faith. If the parties are unable to resolve Customer’s objection within thirty (30) days of Customer’s notice, Customer may terminate the AI Plan without penalty upon written notice to Provider. Customer agrees that its use of the AI Communication Features is subject to Provider’s Privacy Policy and, to the extent applicable, Provider’s data processing terms governing the Services.

3.2 No AI Training on Identified Customer Data. Customer Data and Lead Personal Data will not be used to train or fine-tune any AI model in a manner that identifies or could reasonably be used to identify any individual. Provider may compile aggregated, anonymized, and/or de-identified data derived from the AI Communication Features, provided that such data does not identify and cannot reasonably be used to identify any individual, and may use such aggregated and/or de-identified data solely for its internal business purposes related to improving the AI Communication Features. Provider shall not attempt to re-identify such data or combine it with other data for the purpose of identifying any individual.

3.3 Ownership; Confidentiality. Customer Materials and Customer Data (including Lead Personal Data as defined in Section 1) remain Customer’s property as set out in the Base Terms. All Personal Data processed in connection with the AI Communication Features is subject to the confidentiality obligations in the Base Terms.

3.4 Customer Data Warranty. Customer represents and warrants that it has obtained all necessary consents and permissions required under applicable law to provide Customer Data and property information to Provider for use in connection with the AI Communication Features, and that it maintains accurate and up-to-date opt-out and suppression lists.

4. Performance

Provider will use commercially reasonable efforts to ensure that the AI Communication Features are available and that outbound communications to Leads are delivered in a timely manner as part of the Services generally. The availability commitment and sole remedy for downtime set forth in the Base Terms apply to the AI Communication Features. Provider does not guarantee any specific leasing outcome or Lead conversion rate as a result of the AI Communication Features.

5. Disclaimers

AI-generated communications are produced by automated systems and may contain errors, inaccuracies, hallucinations, fabricated information, or content that is not grounded in the property data provided by Customer and does not perfectly reflect a property’s current conditions or Customer’s preferences. Provider does not warrant that AI-generated communications will be free from such errors or that the content thereof will be accurate, complete, or fit for any particular purpose. THE AI COMMUNICATION FEATURES AND ALL COMMUNICATIONS GENERATED THEREBY ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. THE DISCLAIMERS IN THE BASE TERMS APPLY IN FULL TO THE AI COMMUNICATION FEATURES, INCLUDING WITHOUT LIMITATION THE DISCLAIMER OF ANY WARRANTY THAT THE AI COMMUNICATION FEATURES WILL NOT CAUSE AN ADVERSE OR DISPARATE IMPACT ON A LEGALLY PROTECTED CLASS. PROVIDER EXPRESSLY DISCLAIMS LIABILITY FOR THE PERFORMANCE OR OUTPUT OF ANY THIRD-PARTY AI PROVIDER.

No intellectual property rights are granted or assigned to Customer in or to any AI-generated communications or outputs produced by the AI Communication Features. Provider makes no representation or warranty that AI-generated communications or outputs will not infringe, misappropriate, or otherwise violate the intellectual property rights of any third party. Customer assumes all risk associated with its use, reproduction, or distribution of AI-generated content. For the avoidance of doubt, Provider’s intellectual property indemnification obligations under the Base Terms do not extend to AI-generated communications or other outputs produced by the AI Communication Features, and Customer’s sole remedy with respect to any such third-party claim is as set forth in these Supplemental Terms.

6. Liability

6.1 Cap. The liability limitations in the Base Terms apply in full to claims arising out of or relating to the AI Communication Features.

6.2 AI-Specific Carve-Outs. Without limiting the foregoing, and to the maximum extent permitted by applicable law, Provider has no liability for: (a) any inaccuracy, error, omission, or hallucination in an AI-generated communication, including any incorrect statement of property availability, rent, or lease terms, regardless of whether such inaccuracy results from Customer-provided data, the underlying AI model, or any Sub-processor; (b) any claim, regulatory action, or civil judgment arising from Customer’s leasing policies, qualification criteria, or screening practices, including any finding of disparate impact or disparate treatment under the Fair Housing Act or any other anti-discrimination law; or (c) any claim arising from Customer’s use of AI-generated call or text data (such as transcripts or summaries) in making leasing decisions.

6.3 Customer Indemnification. In addition to Customer’s indemnification obligations under the Base Terms, Customer agrees to indemnify, defend, and hold Provider and its affiliates, suppliers, officers, employees, and agents harmless from any claim by a Lead, tenant, or regulatory authority arising from: (i) Customer’s leasing policies, qualification criteria, or screening practices as applied to information derived from the AI Communication Features; (ii) Customer providing inaccurate or misleading property data that causes the AI Communication Features to generate incorrect communications; or (iii) Customer’s failure to maintain accurate and up-to-date opt-out and suppression lists as required under these Supplemental Terms.

7. Pricing

Fees for the AI Plan are as set forth in Customer’s applicable Plan or Order Form, which may be in addition to Customer’s base subscription fees. The recurring billing and authorization provisions of the Base Terms apply to AI Plan fees. Provider reserves the right to change the AI Plan pricing upon at least thirty (30) days’ prior written notice to Customer; if Customer does not wish to accept such changes, Customer must cancel its AI Plan in accordance with Section 8.2 prior to the effective date of the change, failing which Customer will be deemed to have accepted the updated pricing. Upon Customer’s written request made within sixty (60) days of an invoice, Provider shall provide Customer with a summary of the Lead activity underlying such invoice sufficient to verify the Lead count.

8. Term & Termination

8.1 Term. These Supplemental Terms are effective upon Customer’s opt-in and remain in effect for so long as Customer maintains an active AI Plan, unless earlier terminated in accordance with these Supplemental Terms or the Base Terms.

8.2 Termination by Customer. Customer may terminate the AI Plan in accordance with the cancellation procedures in the Base Terms, with the AI Communication Features ceasing at the end of the then-current billing period.

8.3 Downgrade/Termination for Underperformance. If the AI Communication Features fail to meet the availability standard set forth in the Base Terms for two (2) or more consecutive calendar months, as documented by Customer’s written records of downtime notifications made to Provider in accordance with the Base Terms during such period, Customer may, upon thirty (30) days’ prior written notice to Provider, elect to downgrade or terminate the AI Plan without incurring any early termination penalty attributable solely to such underperformance, provided Customer provides Provider with reasonable written documentation of the failures.

8.4 Termination by Provider. Provider may suspend or terminate Customer’s access to the AI Communication Features under the same circumstances permitting termination of a Plan under the Base Terms, and may additionally suspend the AI Communication Features immediately if Customer’s use creates, in Provider’s reasonable judgment, an imminent risk of harm to any individual, regulatory exposure, or reputational harm.

8.5 Effect. Upon termination of the AI Plan, Customer’s access to the AI Communication Features ceases and the Base Terms continue in full force with respect to all other Services. Provider shall, at Customer’s election and written request made within thirty (30) days of termination, return or delete all personal data processed in connection with the AI Communication Features that is in Provider’s or its Sub-processors’ possession or control, except to the extent that applicable law requires retention of such data. Provider shall confirm such deletion in writing upon Customer’s request.

8.6 Survival. Sections 3 (Data & Privacy), 5 (Disclaimers), 6 (Liability), and this Section 8.6 survive termination of the AI Plan.

The following Sub-processors are engaged by Provider in connection with the delivery of the AI Communication Features as of the Effective Date. This list supplements, and does not replace, any sub-processors disclosed under Provider’s data processing terms governing the Services.
